    On June 22, Connecticut became the 19th state to legalize recreational marijuana.  Possession of small quantities of marijuana immediately became legal.   Although most of the employer provisions don’t go into effect until July 2022, there are some more immediate concerns:

    • Are there current policies in your handbook that need to be changed now? 

    • Will your employer be exempted from the new legislation – and what does that mean?  

    • Should employers remove marijuana screening from their pre-employment physicals now?

    • Can you test current employees for reasonable suspicion?

    • Can you refuse to hire an employee, or terminate an existing employee, who admits to recreational marijuana use off-hours?

    • Does this law pertain to employees who work in other states, but are employed by a Connecticut company?
